Please read these Terms of Service carefully before using Halalytic. By accessing or using our platform at halalytic.com, you agree to be bound by these terms. If you do not agree, do not use the platform.
1. Acceptance of Terms
By creating an account, accessing, or using any part of the Halalytic platform, including our website, APIs, Islamic will generator, power of attorney generator, inheritance calculator, stock screener, zakat calculator, and all related tools and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using Halalytic on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Platform Description
Halalytic is an informational and educational technology platform. It is NOT a law firm, does not provide legal advice, and is not a substitute for the advice of a qualified attorney.
Halalytic provides software tools that automate calculations, generate document templates, and present financial data. These tools are designed to assist users in making informed decisions about Islamic finance, estate planning, and Shariah compliance. The platform includes, but is not limited to: stock screening based on AAOIFI financial ratios, zakat calculation using real-time market data, Islamic inheritance (Faraid) calculation, will and power of attorney template generation, portfolio compliance analysis, and market intelligence tools.
All outputs from Halalytic are for informational and educational purposes only and should not be relied upon as legal, financial, tax, or religious advice.
3. Account Terms
To access certain features of Halalytic, you must create an account. You agree to:
- Be at least 18 years of age
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your login credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these terms, provide false information, or engage in fraudulent or abusive activity.
4. Legal Document Features Disclaimer
Halalytic provides template generation tools for Islamic wills, powers of attorney, and related estate planning documents. These templates are designed for the following jurisdictions:
- Canada: Ontario, British Columbia, Alberta, Quebec
- United States: California, New York, Texas, Michigan, Florida
- United Kingdom: England and Wales, Scotland
- Australia: All states and territories
THESE DOCUMENTS ARE TEMPLATES ONLY. They are not a substitute for professional legal advice. Halalytic does not guarantee that any generated document will be legally valid, enforceable, or sufficient for your specific circumstances. Laws governing wills, powers of attorney, and estate planning vary significantly by jurisdiction and change over time.
You are solely responsible for:
- Reviewing all generated documents with a qualified attorney licensed in your jurisdiction before signing or relying on them
- Ensuring that documents are properly executed in accordance with the laws of your jurisdiction, including witnessing and notarization requirements
- Keeping your documents up to date as your circumstances or applicable laws change
- Verifying that the information you provide to generate documents is accurate and complete
Halalytic expressly disclaims any liability arising from the use, misuse, or reliance on any document generated by the platform.
5. Islamic Guidance Disclaimer
The Islamic guidance provided by Halalytic, including inheritance share calculations (Faraid), will provisions based on Quran and Sunnah, and Islamic estate planning concepts, is based on general Sunni interpretations of Islamic law and commonly accepted scholarly positions.
Islamic jurisprudence (fiqh) varies among the four major madhabs (Hanafi, Maliki, Shafi'i, and Hanbali) and among individual scholars. Halalytic does not represent or warrant that its calculations or guidance reflect the position of any particular scholar, madhab, or Islamic authority.
Users should consult a qualified Islamic scholar or mufti for guidance specific to their personal circumstances, particularly regarding matters of inheritance distribution, bequests (wasiyyah), religious endowments (waqf), and other matters governed by Shariah.
Halalytic does not issue fatwas and nothing on the platform should be interpreted as a fatwa or binding religious ruling.
6. Financial Screening Disclaimer
Halalytic's stock screening tools automate the AAOIFI (Accounting and Auditing Organization for Islamic Financial Institutions) financial ratio analysis, including the 30/30/5 rule for debt ratio, cash ratio, and non-permissible income ratio.
This automated screening:
- Is NOT investment advice and should not be construed as a recommendation to buy, sell, or hold any security
- Does not replace the review and approval of a qualified Shariah scholar or Shariah advisory board
- Relies on financial data from third-party financial data sources which may contain errors, delays, or inaccuracies
- May produce different results from other screening services due to differences in data sources, methodology, or timing
- Cannot account for all factors that a Shariah scholar would consider in a comprehensive compliance review
Users should cross-reference screening results with established services such as Zoya, Musaffa, Islamicly, or Finispia, and consult qualified advisors before making investment decisions.
7. No Attorney-Client or Advisory Relationship
Your use of Halalytic does not create an attorney-client relationship, a financial advisory relationship, a religious advisory relationship, or any fiduciary duty between you and Halalytic, its founders, employees, contractors, or affiliates. No communication through the platform, including document generation, calculation results, or support interactions, constitutes professional advice of any kind.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HALALYTIC, ITS FOUNDERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR USE OF OR INABILITY TO USE THE PLATFORM
- ANY ERRORS, INACCURACIES, OR OMISSIONS IN CONTENT, CALCULATIONS, OR GENERATED DOCUMENTS
- ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN
- ANY LEGAL, FINANCIAL, TAX, OR RELIGIOUS CONSEQUENCES ARISING FROM YOUR RELIANCE ON THE PLATFORM'S OUTPUTS
- ANY THIRD-PARTY CONDUCT OR CONTENT ON THE PLATFORM
- ANY DOCUMENTS THAT ARE FOUND TO BE LEGALLY INVALID OR UNENFORCEABLE IN YOUR JURISDICTION
IN NO EVENT SHALL HALALYTIC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE USE OF THE PLATFORM EXCEED THE AMOUNT YOU HAVE PAID TO HALALYTIC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Halalytic, its founders, directors, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: your use of the platform; your violation of these Terms of Service; your violation of any rights of a third party; any documents generated using the platform; or any reliance on the platform's outputs for legal, financial, religious, or tax purposes.
10. Intellectual Property
All content, software, algorithms, designs, text, graphics, and other materials on Halalytic are the property of Halalytic or its licensors and are protected by Canadian and international intellectual property laws.
You retain all rights to the personal data you provide to the platform and to the documents generated for your use. You grant Halalytic a limited license to process your data solely for the purpose of providing the services you request.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the platform without prior written consent from Halalytic, except as expressly permitted by these terms or applicable law.
11. Data and Privacy
Your use of Halalytic is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the platform, you consent to the practices described in the Privacy Policy.
12. Modifications to Terms
Halalytic reserves the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on the platform and updating the "Last Updated" date. Your continued use of the platform after such changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
13. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
14. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
